Rules and Regulations

These terms are an agreement between Softpress Systems Limited (Softpress) and any Softpress Web Site Visitor (Author) who chooses to submit a Web site to Softpress for inclusion in the Softpress Gallery feature (Gallery) of the Softpress Web Site. These terms extend any other existing license or agreement between Softpress and the Author. If Author is acting on behalf of a business or corporation of any kind (Company), Author affirms that he or she is acting as a representative of that Company, and is authorized to enter into a legally binding contract on behalf of that Company.

BY ACCESSING THIS WEB SITE OR SUBMITTING INFORMATION TO THE GALLERY, AUTHOR ACKNOWLEDGES ACCEPTANCE OF THESE TERMS AND CONDITIONS. SOFTPRESS RESERVES THE RIGHT TO CHANGE THESE RULES AND REGULATIONS FROM TIME TO TIME AT ITS SOLE DISCRETION. IN THE CASE OF ANY VIOLATION OF THESE RULES AND REGULATIONS, SOFTPRESS RESERVES THE RIGHT TO SEEK ALL REMEDIES AVAILABLE BY LAW AND IN EQUITY FOR SUCH VIOLATIONS. THESE RULES AND REGULATIONS APPLY TO ALL SUBMISSIONS TO THE GALLERY, BOTH NOW AND IN THE FUTURE.

Privacy

By submitting a site to the Gallery for consideration, Author agrees that Softpress may publish any information provided as a part of the submission process, including personally identifying information. Softpress will not publish Author’s e-mail address within the site.

Submissions

By submitting a site to this service for consideration and listing, Author affirms the following to be true:

The submitted site was created in Softpress Freeway (any version) and contains the original Freeway GENERATOR META TAG within the source code, and the Author undertakes that the aforementioned tags will remain unobscured during the site’s tenure in the Gallery.

The description of the site, authorship information, and other metadata which accompany the address of the submitted site are accurate.

The submitted site is the Author’s own work, and does not infringe in whole or in part on the copyright or ownership of another individual or company. Author further agrees to hold harmless and vigorously defend Softpress in any claim of infringement or any other claim which may arise through the listing of the submitted site in the Gallery.

Author further agrees to notify Softpress within 30 days of discovery if any of the foregoing ceases to be true. Notification may take the form of e-mail, fax, or postal mail.

Failure to comply with the foregoing terms will, in addition to any other relief sought by Softpress, be grounds for removal of the submitted site from the Gallery.

Removal of a submitted site from the Gallery will not reduce the requirement of the Author to hold harmless and vigorously defend Softpress in any claim of infringement or any other claim which may arise through the previous listing of the submitted site in the Gallery.

Editorial Policy

Softpress reserves the right to edit text descriptions of the site submitted to the Gallery for length, content, and clarity, and to refuse to list sites that, in its sole editorial discretion, are not appropriate for inclusion. Submission by Author of a site to the Gallery does not constitute an agreement by Softpress to list that site in the Gallery. Decisions of the editor are final.

Survivability

This agreement will remain in force through heirs or assigns after the dissolution of one or more of the parties thereto.
